RECENT RESULTS - DRUG AND MEDICAL DEVICES
Our experience in this field dates back to the inception of
the Bendectin® litigation in the early 1980’s. Examples of our
work in this area include:

Efficient resolution of multiple DES cases in Washington, D.
C. and Baltimore, Maryland.
·
No payment dismissal of cases alleging SSRI-induced suicide
and attempted suicide in Salt Lake City, Utah.
·
Voluntary non-suit of “serotonin syndrome” wrongful death action,
following the filing of Motion for Summary Judgment in Houston, Texas.
·
Dismissal of an action in Philadelphia, Pennsylvania, on grounds
of forum non conveniens, regarding recalled prescription medication
incorrectly made by South American contract manufacturer.
·
Complete resolution within 8 months of putative national class
action filed in Philadelphia County, Pennsylvania, involving recalled medical
device blamed for serious infection-related injuries.
·
Mediated to successful conclusion a wrongful death action in
Beaumont, Texas, involving surgically implanted absorbable mesh blamed for
retroperitoneal abscess, peritonitis and multi-organ failure.
In addition to these individual cases, Whitney & Bogris
has been involved in the following drug and device litigation:

In defense of a recalled statin, as a member of a National
Science Team which was charged with retention and preparation of experts in
fields of: Pharmacology, Neurology, Nephrology, Cardiology, Endocrinology,
Epidemiology, Renal Disease, Lipid Metabolism and FDA regulations.

National Coordinating Counsel for manufacturer of latex gloves
sued in 380 cases in 44 states. Tried two cases to defense jury verdict,
secured zero payment dismissals of over 125 cases, negotiated minimal settlements
and assisted in related insurance coverage dispute achieving extremely favorable
overall resolution of litigation.
