ATTORNEYS Gerald S. Gaetano / Partner Overview: Mr. Gaetano has extensive experience in defending medical and laboratory malpractice cases. As co-trial counsel in the U.S. District Court for the Eastern District of New York, he helped obtain a defense verdict on a claim of melanoma metastasis due to failure to diagnose. He has also successfully defended cases involving similar claims of metastasis of melanoma and breast cancer in New Jersey and Pennsylvania, as well as cases involving fear of recurrence of cancer, fear of HIV, failure to report and untimely reporting, fainting-related injuries, and genetic-testing wrongful birth claims. He also recently obtained a defense verdict in Camden County, New Jersey, in a case alleging improper reporting of herpes results. Mr. Gaetano’s practice also includes products liability litigation involving medical, fire and life safety, and flow control products. In addition to direct involvement in the defense of Whitney & Bogris’ clients in these areas, he also oversees the firm’s docket of cases of all types in New Jersey. Prior to joining Whitney & Bogris, Mr. Gaetano was a Senior Staff Prosecutor for the Commonwealth of Pennsylvania in the Department of State, Bureau of Professional and Occupational Affairs. As a Senior Staff Prosecutor, he prosecuted hundreds of cases before the Pennsylvania Medical, Pharmacy and Accountancy Boards and the State Real Estate Commission, including trial of over 40 cases before hearing examiners and the Licensing Board. Mr. Gaetano was elected to partnership in October 2000, after his service as an associate.
